(1) The rules ofprocedure to be adopted for election petitions and appeals arising therefromshall be as set out in the First Schedule to this Act.

(2) The Presidentof the Court of Appeal may issue practice directions to

election tribunals.

 

FIRST SCHEDULE

 

Rules of Procedurefor Election Petitions

 

Security for costs

(1) At the time ofpresenting an election petition, the petitioner shall give security for allcosts which may become payable by him to a witness summoned on his behalf or toa respondent.

(2) The securityshall be of such amount not less than N5,000.00 as the

Tribunal or Courtmay order and shall be given by depositing the amount with the Tribunal orCourt.

(3) Where two orthree persons join in an election petition, a deposit as may be ordered undersubparagraph (2) of this paragraph of this Schedule shall be sufficient.

(4) If no securityis given as required by this paragraph, there shall be no further proceedingson the election petition.
