Chapter 2: Electoral Commission of Namibia

2. (1) The Electoral Commission established by section 3 of the repealed Act, continues to exist as the Electoral Commission of Namibia, the shortened form of which is the “ECN”, and which may be used as an alternative to the name Electoral Commission of Namibia.

Powers and Functions of the Commission

4. (1) Subject to the Namibian Constitution and this Act, and in particular with due regard to Schedule 2 and any other law, the Commission -

a. is the exclusive authority to direct, supervise, manage and control in a fair and impartial manner and without fear, favour or prejudice any elections and referenda under this Act; and

b. must exercise and perform its powers and functions, subject to section 2(3), independent of any direction or interference by any other authority or any person.
