COMELEC RULES OF PROCEDURE
Pursuant to Section 6 of Article IX-A and Section 3 of Article IX-C ofthe Constitution of the Republic of the Philippines and the powers vested in itby existing laws, the Commission on Elections hereby promulgates the followingrules governing pleadings, practice and procedure before it or any of itsoffices:
Rule 19 - Motions for Reconsideration
Section 1. Grounds of Motion for Reconsideration. - A motion forreconsideration may be filed on the grounds that the evidence is insufficientto justify the decision, order or ruling; or that the said decision, order orruling is contrary to law.
Section 2. Period for Filing Motions for Reconsideration. - A motion toreconsider a decision, resolution, order, or ruling of a Division shall befiled within five (5) days from the promulgation thereof. Such motion, if notproforma, suspends the execution or implementation of the decision, resolution,order or ruling.
Section 3. Form and Contents of Motion for Reconsideration. - The motionshall be verified and shall point out specifically the findings or conclusionsof the decision, resolution, order or ruling which are not supported by theevidence or which are contrary to law, making express reference to thetestimonial or documentary evidence or the provisions of law alleged to becontrary to such findings or conclusions.
Section 4. Effect of Motion for Reconsideration on Period to Appeal. - Amotion to reconsider a decision, resolution, order or ruling when notpro-forma, suspends the running of the period to elevate the matter to theSupreme Court.
Section 5. How Motion for Reconsideration Disposed Of. - Upon the filingof a motion to reconsider a decision, resolution, order or ruling of aDivision, the Clerk of Court concerned shall, within twenty-four (24) hoursfrom the filing thereof, notify the Presiding Commissioner. The latter shallwithin two (2) days thereafter certify the case to the Commission en banc.
Section 6. Duty of Clerk of Court of Commission to Calendar Motion forResolution. - The Clerk of Court concerned shall calendar the motion forreconsideration for the resolution of the Commission en banc within ten (10)days from the certification thereof.
