COMELEC RULES OF PROCEDURE

Pursuant to Section 6 of Article IX-A and Section 3 of Article IX-C ofthe Constitution of the Republic of the Philippines and the powers vested in itby existing laws, the Commission on Elections hereby promulgates the followingrules governing pleadings, practice and procedure before it or any of itsoffices:

PART IV

DISPOSITION OF ACTIONS OR PROCEEDINGS

Section 4. Period to Appeal or File Motion for Reconsideration WhenExtended Opinion is Reserved. - If an extended opinion is reserved in adecision or resolution, the period to file a petition for certiorari with theSupreme Court or to file a motion for reconsideration shall begin to run onlyfrom the date the aggrieved party received a copy of the extended opinion.

Rule 19 - Motions for Reconsideration

Section 4. Effect of Motion for Reconsideration on Period to Appeal. - Amotion to reconsider a decision, resolution, order or ruling when notpro-forma, suspends the running of the period to elevate the matter to theSupreme Court.

Section 5. How Motion for Reconsideration Disposed Of. - Upon the filingof a motion to reconsider a decision, resolution, order or ruling of aDivision, the Clerk of Court concerned shall, within twenty-four (24) hoursfrom the filing thereof, notify the Presiding Commissioner. The latter shallwithin two (2) days thereafter certify the case to the Commission en banc.
