Art. 26.

(6) Persons entitled to vote presumably prevented on the day of election to cast their vote before the electoral authority, for example for absence, for reasons of health or staying abroad may make use of their right to vote by postal ballot upon application indicating the reason. The identity of the applicant is to be proven prima facie. The qualified voter has to declare by signature in lieu of oath, that the vote has been cast personally and confidentially.

§ 60. (1) If they are in a possession of a postal ballot paper, voters who are likely to be abroad on the day of election can exercise their right to vote, taking into consideration the regulations set out in paras 2 to 6, by sending within the relevant time period the postal ballot paper to the provincial elections authorities responsible, whose address is indicated on the postal ballot paper.

Eine Stimmabgabe im Ausland ist nur mittels Briefwahl möglich. Auf diese Weise kann bei Bundespräsidentenwahlen, Nationalratswahlen, den Wahlen zum Europäischen Parlament, bei einer Volksabstimmung und einer Volksbefragung die Stimme abgegeben werden. Auslandsösterreicherinnen/Auslandsösterreicher sowie österreichische Wahlberechtigte, die sich am Wahltag im Ausland aufhalten (z.B. Touristen, Geschäftsreisende), müssen dafür rechtzeitig eine Wahlkarte beantragen.

Wahlberechtigte Personen, die sich am Wahltag nicht an ihrem Hauptwohnsitz aufhalten, können ihre Stimme per Briefwahl abgeben. Die Briefwahl im Ausland wurde 1990 für wahlberechtigte ÖsterreicherInnen ohne Wohnsitz in Österreich eingeführt. Seit der Wahlrechtsreform 2007 ist auch die Briefwahl im Inland möglich.
