Who carries out investigation for election-related criminal offenses?

Article 45 (1) Forthe needs of the criminal procedure, an investigation centre of the PublicProsecution Office may be established for the territory of one or more publicprosecution offices.

(2) The investigation centre stipulated inparagraph 1 of this Article shall be established by means of a decision of thePublic Prosecutor of the Republic of Macedonia.

(3) The total number of the judicialpolice in the investigation centres of the Public Prosecutor is determined withdecision by the Public Prosecutor of the Republic of Macedonia, based on thesuggestion of the Minister of Internal Affairs, Minister of Justice and theMinister of Finance.  

(4) The activities in the InvestigationCentre are performed by the employees in the organizational units stipulated inArticle 48 line 2 of the Code herein, who are elected to perform activities fordefinite period, through an internal announcement, as well as employees in thePublic Prosecution in accordance with the Jaw on Public Prosecution.

(5)The employees from line 4 in thisarticle can participate in undertaking the investigative activities, acceptreports and suggestions, as well as undertake investigative activities on theirown entrusted by the Public Prosecutor. The report for this kind of activitieshas to be approved by the public prosecutor 48 hours since the activity atstake.

(6) The employees who are elected to workin the Investigation Centre are at the disposal of the Public Prosecutor, theywork under his control and supervision, they abide by and perform the orders ofthe Public Prosecutor, work under his instructions and guidelines and report tothe Public Prosecutor for their work.

(7) Throughout the period while theemployees are elected to work in the Investigation Centre, they may not bereassigned in their originating state bodies to any other job position or beremoved from working on a specific case without the explicit approval of thePublic Prosecutor
