Article 48. Recount of the Voting Results

1. A candidate or proxy who was present inthe process of summarizing the voting results in the electoral precinct, ora  precinct electoral commission memberwho recorded his special opinion on the procedure by which the voting resultswere summarized in the protocol of the voting results in the electoralprecinct, shall have the right, in the procedure and time periods prescribed bythis Code, to appeal the voting results in the electoral precinct concerned bymeans of filing with the territorial electoral commission an application forrecounting the voting results in the electoral precinct (hereinafter “arecount”). An application to recount the voting results in the electoralprecinct may be filed only with the respective territorial electoral commissionfrom 12.00 to 18.00 on the day following the voting.6. The recount process shall start at 09:00 on thenext day following the time limit prescribed for filing recount applicationsand shall end at 14.00 on the fifth dayfollowing the voting day (hereinafter referred to as “the deadline forthe recount”).

Article 74 8. On the fifth dayafter the voting day, the territorial electoral commission shall, basedon the protocol on constituency voting results, court judgments, decisions madeas a result of reviewing applications (complaints) received in the commission,and the decision adopted on the violations recorded on the voting day in thejournals of records of precinct electoral commissions, summarize the constituency voting results andadopt a decision on the election results.

 

Article 126. 10. An application challenging the decisionadopted based on the results of National Assembly elections under themajoritarian electoral system may be lodged withthe Constitutional Court prior to 18:00 hours on the fifth dayfollowing the official announcement of the election result.

 

Article 74. 18. In cases of disputes relatedto the results of the parliamentaryelections by individual system the Constitutional Court shall make a decision within one month after the dayof registration of the appeal.

Article 75. 6. On the seventh dayafter the voting day, theCentral Electoral Commission shall, based on the protocol on the votingresults, court judgments, decisions taken as a result of reviewing applications(complaints) received by the commission, decisions adopted by territorialelectoral commissions regarding violations recorded on the voting day in thejournal of records of precinct electoral commissions, and decisions on thevoting results, summarizethe election results and adopt a decision on the results of the elections.

 

Article 125. 12. An application challenging the decisionadopted based on the results of National Assembly elections under theproportional electoral system may be lodged with the Constitutional Court prior to 18:00 hours on the fifth day following theofficial announcement of the election result.
