Niue Assembly Act 1966, PART 5 DISPUTED ELECTIONS

95 Result of inquiry

(1) The Judge shall determine whether,by reason of some irregularity that in his opinion materially affected theresult of the election, the election is void; or whether the candidate whoseelection is complained of, or any and what other candidate, was duly elected.

(2) The Judge shall cause anydetermination under this section to be transmitted to the Clerk of theAssembly, who shall forthwith –

(a) Publicly notify any suchdetermination;

(b) Where any election is determined tobe void, declare the seat vacant under section 10;

(c) Where any other candidate isdetermined to be elected, declare that candidate to be elected under section 70and revoke any warrant previously issued by him under that section which is notconsistent with the determination.
