58. What sanctions are provided for political finance infractions?

Article 21

Les violations des dispositions de la présente loi, notamment les fausses déclarations, entraînent la suspension du droit à la subvention, sans préjudice de poursuites judiciares.

ARTICLE 41

Toute infraction aux dispositions des articles 30 et 31 ci-dessus est passible d’une amende de 250 000 à 750 000 francs.

Besides the suspension of public funding, the law on political party finance refers to the possibility of criminal prosecution. However, the penal code does not contain any provisions for offences related to political party or campaign finance. Possibly, the provisions concerning the abuse and embezzlement of public funds and titles (Art- 225-228) and undue advantage (Art. 231-235) are applicable.
