Article 46. 3. An application on declaring as invalid the votingresults in an electoral precinct may be filed by:

(1) A candidate, as well as apolitical party (alliance of political parties) participating in theelections under the proportional electoral system;

(2) A proxy, if he waspresent in such electoral precinct;

(3) A member of the relevantprecinct electoral commission, if he has recorded a special opinion in theprotocol; or

(4) A member of the CentralElectoral Commission. An application on declaring as invalid theelection results may befiled by a candidate, or by a political party (alliance of political parties)participating in the elections under the proportional electoral system.

Article 48. 1. A candidate or proxy who was present in theprocess of summarizing the voting results in the electoral precinct, or aprecinct electoral commission member who recorded his special opinion on theprocedure by which the voting results were summarized in the protocol of the votingresults in the electoral precinct, shall have the right, in the procedure andtime periods prescribed by this Code, to appeal the voting results in theelectoral precinct concerned by means of filing with the territorial electoralcommission an application for recounting the voting results in the electoralprecinct (hereinafter “a recount”).
